Abstract

In this analysis, we start from the antecedents of the suspension of rights in the constitutional laws that have governed Mexico, to later review the issue particularly in the constitution of Spain. Also, since Mexico is part of the member states of the American Convention on Human Rights, it refers to how it regulates such limitation, in order to analyze the current text derived from the reforms suffered in Article 29 of the 1917 Constitution, current of Mexico, which is where the constitutional possibility of limiting fundamental rights is sustained. Next, it is specified, answering various questions, what are the requirements to be able to suspend or restrict human rights in accordance with the Mexican constitutional order? pandemic? Derived from all the above, the conclusions of the present essay are finally pointed out.
