Abstract

This work addresses the importance of evidence in the jurisdictional process, the various criteria adopted by the doctrinaire for its classification, as well as the interesting assumption that it is evidence for the process, as well as to make conviction in the judge. In this sense, the various means of proof considered by the General Theory of the Process acquire relevance, to which, currently, the various elements that the advances of digital technology contribute, means that require improvement. It also affects the diverse application of the methodstwo of evaluation of the evidence, with its various implications in the process and the final resolution, to conclude with the importance of the means of conviction to obtain a favorable judgment in the process and the role of the Judge in settling the controversy, at the time to issue the resolution collecting what is called legal estimate.
